1. Granting of License
This software is provided free of charge for personal, non-commercial use. You may use the program:
- Download, install and use for private purposes.
- Modify to adapt it to your personal needs (e.g. adjustments to Darktable or AI configurations).
- Copy and share as long as this is also done free of charge and non-commercially (e.g. to share with friends or in forums).
These rights apply only to natural persons and not to companies, organizations or commercial activities.
2. Prohibited Use
The following actions are strictly prohibited and require the author’s written permission:
- Commercial use, including but not limited to:
- Integration into commercial software, products or services.
- Sale, rental, leasing or other monetization of the program or its derivatives.
- Use in paid services, consultations or projects (e.g. as part of a photography service for a fee).
- Spread in modified form if it pursues commercial intentions.
- any use that violates applicable law (e.g. copyright infringement or data protection violations).
In the event of violation of these terms, this license will automatically expire and you must stop using it immediately.
3. Disclaimer and Warranty
The software is provided “as is” (AS-IS) without any guarantee or warranty. The author assumes no responsibility for:
- The functionality, reliability or security of the program.
- Damage of any kind arising from use, including data loss, hardware damage or indirect consequences (e.g. through AI analyses or image processing).
- Violations of third-party rights (e.g. copyrights to images or AI models).
The author is not liable for direct, indirect, accidental, special or consequential damage, unless these were caused by gross negligence or intent by the author. This does not apply to legally mandatory liability claims (e.g. in the case of personal injury).
You use the software at your own risk. Test them in critical applications before using them.
4. Changes and Derivatives
If you modify the program, you must retain this license in the modified versions and name the author as the author. Modified versions may only be passed on under the same conditions.
5. Privacy and AI Use
The program uses local AI APIs (e.g. LMStudio). Make sure that your use complies with data protection regulations (e.g. GDPR). The author is not liable for data protection violations through your use.
6. Applicable Law and Jurisdiction
This license is subject to German law. In the event of disputes, the court at the seat of the author (Germany) is responsible.
